St. Charles Twp. man charged with felony aggravated domestic battery

Man also charged with 2 counts misdemeanor domestic battery

ST. CHARLES TOWNSHIP – A St. Charles Township man was charged with felony aggravated domestic battery following an incident in which he allegedly injured a family member by striking the victim in the face, according to police and court records.

Timothy O. Schroeder, 50, of the 35W700 block of Rose Avenue, St. Charles Township, was also charged April 1 with two misdemeanor counts of domestic battery. He was released on his own recognizance and is scheduled to appear in court Thursday, court records show.

Kane County Sheriff’s deputies were called to the home on Rose Avenue shortly after 6 p.m. on March 31 when a witness called to report seeing another family member being struck by Schroeder, the report stated.

According to witnesses, Schroeder “came in the house yelling and calling (the victim) names,” the report stated. “Timothy threatened to move all of the motorcycle stuff out of the shed so he could fix the water well. … (The victim) ended up on the porch trying to avoid the confrontation (with) Timothy. … Timothy kept getting closer and closer to (the victim) and that is when he hit (the victim) with an open hand, scratching (the victim’s) forehead.”

Schroeder pushed in the home’s air conditioning unit through the window while continuing to call the victim names, the report stated.

Schroeder told deputies the victim “was foaming at the mouth and tried swinging on him,” the report stated. The victim “followed (Schroeder) outside to the front window where the air conditioning unit is and tried attacking him again. That is when Timothy fell back and the air conditioning unit fell into the residence.”

Schroeder told deputies he was upset because the shed was not cleaned out and motorcycle parts were all over, the report stated.

“Timothy admitted to striking (the victim) but only in self-defense,” the report stated.

Witnesses told deputies that Schroeder was the aggressor in the incident and the victim had not struck Schroeder, the report stated.

Schroeder pleaded guilty to a charge of domestic battery in 2006 for which he paid a fine and received a 12-month conditional discharge and was ordered to receive domestic violence counseling, court records show.
