Settlements reached in Aquascape roof collapse lawsuit

ST. CHARLES – A series of settlements were recently reached in a lawsuit tied to the 2011 Aquascape roof collapse in St. Charles, according to court records.

The settlements, which were reached with eight different defendants in the lawsuit, total at least $259,000, according to the court records. The settlement reached with Dubuque, Iowa-based Tricon Construction Group that was provided in court records did not specify a dollar amount.

Aquascape in 2013 filed a suit seeking $13 million in damages against various businesses involved in the construction of its green roof, a large section of which collapsed Feb. 13, 2011. No one was injured in the incident.

Kane County Judge James Murphy on Sept. 30 dismissed Tecza Environmental Group of Elgin from the suit after it paid a $30,000 settlement, according to court records.

Area Erectors of Rockford also was dismissed after paying $32,000.

Other settlements include $95,000 from Metallic Building Company of Houston, $32,000 from Applied Ecological Services Inc. of Brodhead, Wisconsin; $25,000 each from Dewberry Architects of Fairfax, Virginia, and Olsson Roofing of Aurora; and $20,000 from Senekekts of Monroe, Wisconsin.

Artisan Design Buildings Inc. is the main defendant and is still attached to the suit. Artisan intends to file a motion sometime before the case’s next court date to dismiss the lawsuit, confirmed Robert Martier, one of the attorneys representing Artisan, in an email on Monday.

Martier provided no further details on what the motion would contain.

The next status hearing in the case is Nov. 7, according to court records.
