BREAKING: Bond set at $250,000 for mother, stepdad charged with involuntary manslaughter in 6 year-old's death

YORKVILLE - Kendall County Judge Jody Gleason set bond at $250,000 with 10% to apply Friday afternoon for the mother and stepfather of 6 year-old Kerrigan Rutherford, who was found dead in a Boulder Hill home July 2.

The Kendall County State's Attorney's Office supported the bond amount.

Kendall County Sheriff's Office detectives arrested James A. Davidson, 29, and Courtny A. Davidson, 32, both of the 800 block of Washington Street in Mendota, on Thursday, Aug. 6 and charged both in connection with Rutherford's death, according to a Thursday news release from the Kendall County Coroner's Office and sheriff's office.

The Kendall County State’s Attorney’s Office approved one count of involuntary manslaughter, which is a Class 2 felony, and two counts of endangering the life or health of a child, which are Class 3 felonies, against both suspects.

If convicted of the involuntary manslaughter charge, the two adults could face up to 14 years in prison each. The maximum possible prison terms for the rest of the charges are five years each.

Kendall County Sheriff's Dep. Dan Briars confirmed on Thursday that Courtny Davidson was Kerrigan's mother and James Davidson was Kerrigan's stepfather.

Law enforcement officials alleged in Kendall County court documents that both adults "unintentionally and recklessly performed acts which were likely to cause death or great bodily harm to [Kerrigan]" and gave Kerrigan enough prescription olanzapine pills to cause her death, according to court records.

According to the U.S. National Library of Medicine, olanzapine is used to treat symptoms of schizophrenia and bipolar disorder in adults and teenagers 13 years old or older.

Courtny Davidson is or has been diagnosed with bipolar disorder, according to court records. James Davidson is not or has not been diagnosed with any mental health disorder, per court records.

Mark Shlifka, first assistant state's attorney for Kendall County, said in court on Friday that both adults tried to avoid responsibility for Kerrigan's death and alleged that they were not as forthcoming as they should have been to law enforcement about what happened. In requesting Gleason to set bond to $250,000 each for Courtny and James Davidson, he said the prescription drugs that were found in Kerrigan's system, per toxicology reports, were not meant for her.

"Or for any child at all," Shlifka said.

Kendall County Public Defender Victoria Chuffo was appointed to defend Courtny and James Davidson for both of their cases. She said in court Friday she represents both adults in another pending case involving the Illinois Department of Children and Family Services.

On Friday, court officials confirmed Courtny Davidson's 3 year old child, who is James Davidson's stepchild, was removed from the residence following Kerrigan's death.

Gleason also ruled that neither adult could have contact with any child 18 years old and younger as a bond condition. However, she said Courtny Davidson may have supervised visits with her 3 year old child and James Davidson may visit with his stepchild via Zoom video call, provided if it's recommended by DCFS.

According to court records, both adults had lived in the residence within the 100 block of Boulder Hill Pass in Boulder Hill, where Kerrigan was found dead last month, for a year. They recently moved to their current listed residence in the 800 block of Washington Street in Mendota and have been living there for about a month.

A review of court records showed entries – mostly traffic cases – for Courtny Davidson, under her married and maiden names, in Kendall County but none in La Salle County. Her Facebook page, updated as recently as July, listed her city of residence as Montgomery. The unincorporated Boulder Hill subdivision where the couple lived has a Montgomery mailing address.

Additionally, a law enforcement source, speaking on condition of anonymity, described the Davidsons' listed Mendota residence as a converted hotel populated by transients.

Rutherford was a kindergartener at Boulder Hill Elementary School, according to her obituary. Oswego School District 308 officials previously confirmed Kerrigan was a student in the district and they sent grief counselor information to school staff and families, but the district did not provide further comment to Record Newspapers.

Both suspects are due back in court at 9 a.m. Aug. 12.
