3 men arrested on drug charges after search of Cary home; several others fled the scene, authorities said

Officials warned of police activity in area Monday night

Three men were arrested in a Cary home on drug charges Monday night after police conducted a search warrant, officials report.

David J. Derita Jr., 42, and Kurt M. Niezgoda, 31, both of the 1300 block of Geneva Lane, Cary; and William B. Roach, 33, of Elgin; were all charged with possession of drugs, court records show.

Derita was charged with possession and possession with intent to deliver one to 15 grams of cocaine and possession of less than five grams of methamphetamine, according to records and authorities.

Assistant State’s Attorney Brian Miller filed for Derita to be denied pretrial release, writing that Derita presents a “real and present threat” to the community. Judge Cynthia Lamb granted the motion based on Derita’s past Class 1 felony conviction of possessing drugs and his “extensive criminal history” of “almost yearly arrests,” the judge wrote in court filings.

Derita was previously sentenced to four years in prison in 2020 for entering a woman’s home and battering her while two children were present, according to court documents.

Roach was charged with possession of less than 15 grams of cocaine, obstructing justice, resisting a police officer, possession of drug paraphernalia and possession of unsecured marijuana in a vehicle, court records show.

Roach was “observed leaving the residence just prior to the execution of the warrant,” McHenry County Sheriff’s Office Communications Specialist Emily Matusek-Baker said in an email to the Northwest Herald. Roach was later found by police in a traffic stop, officials said.

According to the criminal complaint against Roach, he “destroyed physical evidence” while being detained by smashing a “crack pipe” from his pocket on the ground. Roach is also charged with pulling away from police to prevent police from putting him in handcuffs, according to the complaint.

Niezgoda was charged with possession of less than five grams of methamphetamine, according to court documents.

Both Roach and Niezgoda were released with pretrial supervision and conditions that include not leaving the state without court approval and submitting to random drug tests. Niezgoda was also ordered to surrender any firearms and not have any contact with Derita.

Niezgoda was out on pretrial release conditions for another McHenry County court case filed in December involving charges of possessing cocaine, heroin and marijuana, court documents show.

The village of Cary sent out a Facebook alert at 10:32 p.m. Monday saying there was police activity near New Haven and Collins drives and that authorities were “searching for subjects that fled from a residence in the area.”

An investigation is ongoing as “several individuals fled the area on foot” before police arrived Monday night, Matusek-Baker said. Police searched the area, but were unsuccessful in finding anyone.

Derita is scheduled to appear in court on Feb. 4, Roach is scheduled to appear on Feb. 19 and Niezgoda is scheduled on Wednesday, according to court documents.
