A Hebron woman and McHenry man remained at the McHenry County Jail on Friday in connection with another man’s fentanyl overdose death.
Casey L. Johann, 23, of Hebron and John M. Maly, 26, of McHenry each is charged in connection with the death of Tyler D. Martin of McHenry.
Johann and Maly face Class X felony charges of drug-induced homicide, punishable by as many as 30 years in prison. Johann also is charged with possession of a controlled substance.
McHenry County sheriff’s deputies found Martin dead Oct. 24 in his McHenry home, court records show. An autopsy revealed that the man died of a fentanyl overdose.
Johann and Maly are accused of delivering or assisting in the delivery of fentanyl to Martin the night before he was declared dead, court records show. Johann also is accused of possessing less than a gram of fentanyl on Oct. 24, according to a criminal complaint.
Both Johann and Maly were appointed attorneys from the McHenry County Public Defender’s Office.
Johann, who also is charged in two unrelated traffic and misdemeanor cases, would need to post $25,300 bail to secure her release. Maly’s bond has been set at $500,000. He would need to post $50,000 to be released from the jail.
Based on Maly’s criminal history, which includes several convictions of possession of a controlled substance, prosecutors have asked that he be required to prove the source of any bond money he might post, court records show.
Maly and Johann are due back in court Monday and Tuesday, respectively.
