Officers discovered drugs in Alek Montemayor’s vehicle after pulling over swerving, speeding BMW, court records show

A 27-year-old Harvard man is scheduled for a bond hearing Wednesday after police say they discovered nearly 900 tabs of LSD and more than $13,000 cash in the man’s vehicle during a traffic stop.

Alek A. Montemayor, of the 1300 block of Northfield Court, is charged with possession with intent to deliver more than 30 grams of marijuana, possession of more than 30 grams of marijuana, possession with intent to deliver LSD, and possession of LSD.

After receiving a report of an impaired driver on Friday, Harvard police responded to the McDonald’s at 352 S. Division St., court records show. When police arrived they spotted Montemayor’s black BMW turning north on South Division Street, according to court documents. The officer also saw the vehicle cross over the center line and accelerate while swerving at 80 mph, court records show.

Police stopped Montemayor in the 500 to 600 block of North Division Street and cited him with driving on the wrong side of the road, operating an uninsured vehicle, speeding and driving on a revoked license.

A search of the vehicle yielded more than 30 grams of marijuana, 897 individual perforated tabs of LSD, three cellphones, and a bag containing $13,950, court records show.

If convicted of the most serious charge, possession with intent to deliver LSD, Montemayor could be sentenced to as many as 30 years in prison.

His attorney from the McHenry County Public Defender’s Office has filed a request to reduce Montemayor’s bond on the basis that he is not a flight risk or a risk to the community.

A hearing on that request is scheduled to take place Wednesday afternoon.
