Meyers & Flowers recently secured a $2 million settlement for a Central Illinois family in a wrongful death case involving a sand mine operator. The incident happened back in May of 2020, when an overloaded trailer carrying several thousand pounds of sand detached from a pickup truck and violently collided with the young father’s vehicle, leaving the vehicle unrecognizable and the victim dead at the scene.

The sand mine operator, despite being a licensed mine operator aware of safety regulations under the Federal Mine Safety and Health Act, denied liability and blamed the driver of the vehicle for the incident. However, the firm’s thorough investigation revealed that the operator, KellyCo, failed to check for critical safety issues on the trailer, including its inability to safely haul 11,700 lbs. of sand, improperly wired brakes, and an unsecured breakaway cable—failures that directly led to the tragic accident.
